1. Introduction
Welcome to our platform. By registering and using our services, you agree to these Terms of Service. These terms constitute a binding contract under Indian law.
2. Consent for Data Collection and Sharing
By registering, you provide specific, informed, and revocable consent for the collection and processing of personal data such as name, address, location, phone number, and email. Processing is based on lawful grounds including consent, contractual necessity, and legal obligations. Data will not be used for profiling or marketing without separate consent.
You further consent to the sharing of required personal data with businesses, service providers, and retailers participating on the platform, solely for the purpose of fulfilling your requests, providing services, and enabling transactions. All such third parties are bound by these Terms and our Privacy Policy, and may not use or onward share your data beyond the stated purposes.
2A. Additional Terms for Registered Businesses
If you register a business or add your business to the platform in the future, you agree that:
- Your business will receive customer data only for the purpose of fulfilling orders, providing services, or enabling transactions through the platform.
- Your business must comply with the Privacy Policy, the Digital Personal Data Protection Act, 2023, and other applicable Indian laws when handling customer data.
- Your business may not repurpose, onward share, or exploit customer data outside the permitted purposes.
- Your business indemnifies and holds the company harmless against any claims, penalties, or damages arising from misuse of customer data.
By registering a business, you acknowledge that the platform remains the Data Fiduciary under Indian law, and your business acts as a Data Processor bound by contractual and statutory obligations.
3. User-Uploaded Content Responsibility
You are solely responsible for content you upload and must have rights to upload it. Do not upload unlawful, privacy-violating, or infringing content. We may remove content that violates these terms. You agree to indemnify and hold the company harmless against any third-party claims arising from your uploaded content.
4. Data Storage Location
Personal data is stored securely in India in compliance with the DPDP Act and IT Act, 2000. Cross-border transfer, if any, will follow applicable law, adequacy assessments, and contractual safeguards.
5. Disclaimer and Limitation of Liability
Services are provided on an "as is" basis, subject to applicable law. To the maximum extent permitted, our liability is limited to the total fees paid by you in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages. A force majeure clause applies to events beyond our control.
6. User Rights and Grievance
You may request access, correction, deletion, portability, or consent withdrawal by writing to support@domain.com. A designated Grievance Officer will respond within 30 days as required under Indian law.
7. Governing Law and Jurisdiction
These terms are governed by Indian law. Courts at Noida, Uttar Pradesh, India will have jurisdiction, subject to applicable law. Disputes may first be referred to arbitration under the Arbitration and Conciliation Act, 1996, seated in Noida, conducted in English.
8. Changes to Terms
We may update these terms. Significant changes will be notified in-app or by email. Continued use of services after notification constitutes acceptance of updated terms.
